Terms & Safety

These Terms of Use (“Terms”) govern your use of the AR Sundial Builder mobile app (the “App”) and this website, published by Base Nine Studios (“we”, “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own non-commercial use, subject to these Terms and the app store’s terms. You may not copy, modify, reverse-engineer, resell, or redistribute the App except as permitted by law.

2. Augmented reality safety - assumption of risk

The App displays guidance over a live camera view and asks you to move your device and yourself in the physical world. You are responsible for your own safety and the safety of others and property around you at all times. By using the App you acknowledge and accept the following:

• Stay aware of your surroundings. Do not stare at the screen while walking. Watch for traffic, people, animals, water, cliffs, drop-offs, holes, uneven ground, and other hazards. Stop and look up frequently.
• Never use the App while driving or operating any vehicle, machinery, or equipment.
• Choose safe locations. Do not use the App in traffic, on roadways, on train tracks, near the edges of heights, in restricted or private areas without permission, or anywhere use would be unsafe or unlawful.
• Vertical & elevated dials. Building a wall-mounted or elevated dial may tempt you to use ladders, roofs, scaffolding, or to work at height. Take every ordinary precaution, use proper equipment, and do not attempt anything beyond your ability. You assume all risk of falls and injury.
• Tools & marking. Transferring a dial to a real surface may involve tools, stakes, chalk, drills, or fasteners. Use them safely and follow their manufacturers’ instructions.
• Sun exposure. Building a sundial means working in direct sunlight. Never look directly at the sun. Protect yourself from heat, dehydration, and UV exposure.
• Environmental awareness. Respect private property, protected land, and local rules. Obtain permission before marking, digging, or installing anything on any surface you do not own.

You voluntarily assume all risks associated with using the App, including risks of personal injury, death, and damage to property, whether to you or to others.

3. Accuracy - not for navigation or critical timekeeping

The App computes sundial geometry and solar values (such as true north, solar noon, and latitude) from device sensors, your inputs, and astronomical formulas. These results are estimates and depend on sensor calibration, magnetic interference, GPS quality, weather, the flatness and stability of your surface, and how carefully you follow each step.

• Do not rely on the App or any dial you build for navigation, emergency, legal, scientific, or safety-critical purposes.
• A sundial shows apparent solar time, which differs from clock time (due to the equation of time, your longitude within a time zone, and daylight saving). Treat it as an instrument and a project, not an authoritative clock.
• Always verify important results against an independent, trusted source.

4. No warranty

The App and website are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that results will be accurate or reliable.

5. Limitation of liability

To the maximum extent permitted by law, Base Nine Studios, its owners, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, property, profits, or for any personal injury or death, arising out of or related to your use of (or inability to use) the App or website, even if advised of the possibility of such damages. To the extent liability cannot be excluded, our total aggregate liability is limited to the amount you paid for the App in the twelve months before the claim, or USD $10, whichever is greater.

6. Indemnification

You agree to indemnify and hold harmless Base Nine Studios from any claims, damages, liabilities, and expenses arising from your use of the App, your violation of these Terms, or your infringement of any right of another person or entity.

7. Purchases

Any in-app purchases are sold and processed by Google Play under its terms. Prices, availability, and refunds are subject to the store’s policies.

8. Changes & governing law

We may update these Terms from time to time; the “last updated” date reflects the current version, and continued use constitutes acceptance. These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-laws principles, unless a mandatory law in your jurisdiction provides otherwise.
